Terms of Use
The short version
SwiftServer is a tool that connects to servers you control. You bring the servers, the credentials, and the judgment; the app brings the terminal, the monitoring, and the management tools. You are responsible for what you run and where you connect. We provide the app as is, we do not operate your infrastructure, and purchases are billed and refunded by Apple. The rest of this page says that precisely.
1. Agreement and scope
These Terms of Use are an agreement between you and GitSwift LLC, 30 North Gould Street, Suite R, Sheridan, WY 82801, United States ("GitSwift", "we", "us"). They cover the SwiftServer apps for iPhone, iPad, and Mac, and the swiftserver.app website. By using the app or the website you accept these terms.
The app is distributed through Apple's App Store. Your download and the license to the app copy are additionally governed by Apple's Licensed Application End User License Agreement and, for purchases, the Apple Media Services Terms and Conditions. Apple is not a party to these Terms and is not responsible for the app or its content.
2. What SwiftServer is, and is not
SwiftServer is client software: it connects to, observes, and sends your instructions to servers and services that you choose. It includes live monitoring over SSH, a terminal, Mosh, SFTP file management, snippets, port forwarding, jump host routes, connection proxies, and a Docker management panel.
SwiftServer is not a hosting provider, not a monitoring backend, and not an operator of your systems. We do not run, maintain, back up, or control your servers, your network, or any third-party service you reach through the app, and we have no access to them.
3. Your servers, your responsibility
Everything SwiftServer does, it does because you asked it to, using access you configured. Specifically:
- You are responsible for having the right to access every system you connect to, whether you own it, rent it, or were granted access by someone else.
- Terminal commands, snippets, SFTP operations, Docker actions (starting, stopping, or removing containers, pulling or deleting images, pruning volumes, running Compose operations), port forwarding rules, jump host routes, proxy configurations, and Mosh sessions are initiated by you and executed with your credentials. Review what you run before you run it.
- Consequences of those actions are yours. If a command breaks a service, deletes data, exposes a port that should have stayed closed, or violates the rules of a provider or employer, that risk and responsibility rest with you, not with GitSwift.
- Keep your devices and credentials secure. Anyone with access to your unlocked device and its Keychain can use the connections you saved. The optional Face ID/Touch ID gate for secrets is a convenience, not a substitute for device security.
4. Information shown by the app
Monitoring values, Docker state, latency figures, and IP location details are read from your servers and third parties, and they can be delayed, incomplete, or wrong. IP geolocation in particular comes from ipinfo.io, which itself does not guarantee accuracy. Treat everything SwiftServer displays as a view, not as ground truth, and do not rely on it as your only basis for critical decisions.
5. Availability
We work to keep SwiftServer reliable, but we do not promise that the app, or anything it connects to, will be available or error-free at all times. Your servers, your network, Apple services such as iCloud, and ipinfo.io are outside our control. A failure, outage, misconfiguration, security incident, or data loss on your infrastructure is not our responsibility merely because SwiftServer was the tool you used to observe or reach it.
6. Premium, billing, and refunds
The core of SwiftServer is free. SwiftServer Premium unlocks additional features (unlimited monitored servers, iCloud sync, Docker management actions, jump hosts and proxies, unlimited concurrent port forwarding, terminal customization, SFTP preview and editing, and full IP location details) and is available as a monthly subscription, a yearly subscription, or a one-time lifetime purchase.
- All purchases are made in the app and processed by Apple through your Apple account. We never receive your payment details.
- Subscriptions renew automatically until you cancel in your Apple account settings; cancellation takes effect at the end of the current period. Introductory free trials, where offered, convert to a paid subscription unless cancelled before the trial ends.
- Refunds are handled by Apple under the Apple Media Services Terms; we cannot issue App Store refunds ourselves. Request one at reportaproblem.apple.com.
- Prices are set per region and may change; changes apply only going forward. Premium is tied to your Apple ID and does not support Family Sharing.
7. Third-party services
The app interacts with services we do not operate: Apple (App Store, StoreKit, iCloud, CloudKit, Apple Maps), ipinfo.io for the optional IP lookup made from your server, RevenueCat for anonymous receipt validation, and whatever providers host your servers. Their terms and privacy policies govern their side of those interactions, and we are not responsible for them. How data flows to each of them is described in our Privacy Policy.
8. Acceptable use
Use SwiftServer only in ways that are lawful where you are, and only against systems you are authorized to access. Do not use the app to gain or attempt unauthorized access, to interfere with networks or services, or to violate export control or sanctions rules. You must be legally capable of entering into this agreement to use the app.
9. Intellectual property
SwiftServer, including its design, code, and content on swiftserver.app, belongs to GitSwift LLC and its licensors and is protected by copyright and other laws. These terms give you a personal, non-transferable right to use the app on Apple devices you own or control; they do not transfer ownership, and you may not copy, modify, redistribute, or reverse engineer the app except where the law expressly permits it. Open source components included in the app are listed in Settings and remain under their own licenses. Your data and your servers are, and remain, entirely yours. If you send us feedback or suggestions, we may use them without obligation to you.
10. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWIFTSERVER AND THE WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT IT WILL MEET YOUR REQUIREMENTS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GITSWIFT LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF SWIFTSERVER, INCLUDING DAMAGE TO OR LOSS OF DATA ON SERVERS YOU MANAGE WITH THE APP. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP IS LIMITED TO THE AMOUNT YOU PAID FOR SWIFTSERVER PREMIUM IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR FIFTY US DOLLARS, WHICHEVER IS GREATER. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED BY LAW, INCLUDING, WHERE APPLICABLE, LIABILITY FOR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR YOUR STATUTORY RIGHTS AS A CONSUMER.
12. Termination
You can stop using SwiftServer at any time; deleting the app removes its local data from the device. We may suspend or end your right to use the app if you materially breach these terms. Sections 3, 4, 9, 10, 11, and 13 survive termination.
13. Governing law
These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law rules, and disputes will be resolved in the state or federal courts located in Wyoming, except where the law of your country of residence gives you mandatory consumer protections and venue rights, which remain unaffected. Before going to court, contact us at [email protected]; most issues can be sorted out directly.
14. Changes to these terms
We may update these terms as the product evolves. The effective date at the top always reflects the current version, and meaningful changes will be noted in the app's release notes or on this page. Continuing to use SwiftServer after a change means you accept the updated terms.
